태국정부의 버마영치우노동자연합 탄압에 대한

항의서한

메솟의 이주노동자를 지원하는 단체가 당국의 체포로 고통 받고 있다는 것은 저(우리)에게 큰 충격이었습니다. 얼마 전 한국 가톨릭 교회로부터 ‘지학순 정의평화상’을 수상한 영치우 노동조합의 사무실이 공격받고 통역 자원봉사를 하고 있던 Salam씨를 체포된 사건은 태국 노동자들의 인권에 대한 우려를 낳았습니다.

메솟의 이주노동자들이 태국의 법으로 보장된 노동자의 권리를 동등하게 부여 받지 못하고 있다는 사실은 잘 알려져 있습니다. 게다가 이주노동자들은 ILO가 규정한 조합활동의 자유를 보장받지 못하여 이주노동자의 요구를 대변하여 그들을 지원할 수 있는 노동조합을 만들 수 없습니다.

메솟에 위치한 이주노동자조합은 이주노동자들이 태국 정부와 국제 법으로는 최저 임금과 합법적인 보상, 그 외 다른 권리를 보장받지 못하고 있기 때문에 이주노동자들에게 무료로 자료를 번역해주는 일로 그들에게 필요한 정보와 도움을 제공하고 있습니다. 현재 Tak 주(州)당국은 번역 서비스를 제공하지 않고 있어 미얀마 이주노동자들이 법으로 보장된 권리를 되찾는 것을 거의 불가능하게 하고 있습니다.

당신이 Salam씨의 석방과 안전을 보장하고 조합활동의 자유를 유지하여 태국의 이주노동자들의 권리가 존중될 수 있는 조치를 취하기를 바랍니다.

저는 태국 정부가 현재의 태국법과 국제 노동 법에 따라 모든 이주노동자들을 동등하게 대우하고, 그들의 권리와 존엄을 존중하기를 강력하게 요구합니다. 특히 노동부장관은 이주노동자들의 보호를 위한 특별기구를 창설하고 이를 달성하기 위해 메솟에 부서를 두어야 합니다. 마지막으로 태국 정부가 ILO의 모든 핵심 약정을 비준하고 노동자들에게 태국의 법과 국제법이 명시한 노동자의 권리 (모든 노동자들이 조합을 형성하고 참여할 수 있는 권리를 포함한)를 보장할 것을 요구합니다. 저는 ILO가 이 사건에 관심을 보이고 태국의 이주노동자들이 자신들의 권리를 찾게 될 것이라고 믿습니다.

Re: Harassment of migrant support organizations in Mae Sot

We at Korean NGOs are deeply disturbed by reports that migrant worker support organizations in Mae Sot are being harassed via arrested by local authorities in Mae Sot.  The raid on the office of Yaung Chi Oo Workers Association, recent recipient of the Bishop Tji Hak-Soon Justice and Peace Award from Korean Catholic Church, and the cynical arrest of Mr A Salam, a volunteer interpreter at the instigation of the Tak Labour Protection and Welfare Department, is cause for deep concern of the respect for the rights of workers in Thailand.

The fact that migrant workers in Mae Sot are being denied the equal rights of Thai workers guaranteed to them in Thai labour law is well documented and known.  Additionally, they are being denied the right to freedom of association, as stipulated by the International Labour Organization, and therefore they are unable to form labour unions, which would provide them with the representation that they need and deserve.

Migrant worker support organizations functioning in Mae Sot are providing much needed assistance to migrant workers, free of charge, by interpreting documents workers are forced to submit to the local labour protection department, as they are regularly denied minimum wage, legal compensation and other rights guaranteed to them under Thai and international law. Currently authorities in Tak province do not provide translation services, making it nearly impossible for Burmese migrant workers to redress rights guaranteed to them under the law. 

We trust that you will take action to ensure the acquittal and safety of Mr. A Salam, uphold respect for the right to freedom of association, and that migrant worker’ rights are respected in Thailand.

We urge the Thai government to provide equal treatment to all migrant workers, and to respect their rights and dignity according to current Thai law and international labour law.  In particular, the Ministry of Labour should create a special committee for the protection of migrant workers and establish an office in Mae Sot to achieve this. Finally, We ask that the Thai government ratify all core ILO Conventions, and provide all of its workers the rights that both its own laws and international law must oblige them, including the right of all workers to join and form trade unions. WeI trust that the ILO will take an interest in this matter, and ensure that migrant workers in Thailand have their rights met.

배경설명:

‘(버마)영치우(이주)노동자연합 YaungChiOo Workers Association'

버마 군부독재의 정치경제적 압박과 소수민족말살정책을 피하고자 버마로부터 태국 탁(Tak) 지역 메솟(MaeSot)으로 이주해온 노동자들이 모여 있는 단체이다. 홍콩, 대만 등의 의류다국적기업들이 태국최저임금보다도 싼 임금을 노리고 이 지역에 공장을 운영한다.

영치우는 노동자보호를 위하여 메솟에 2001년에 설립하여 노동권교육, 법률지원, 기술교육 등을 하고 있으며, 태국의료와 교육혜택을 받지 못하는 이주노동자들을 위해 병원과 학교도 운영하고 있다. 이러한 활동이 한국에도 알려져 2004년 12월 10일 제8회 지학순정의평화상을 수상하였다.

영치우는 태국정부로부터 전혀 보호를 받지 못할 뿐 아니라, 활동가와 노동자들이 회사와 태국관련기관으로부터 폭력의 위협에 항상 노출되어 있다. 활동가가 살해된 경우도 있으며 2004년 5월 메솟시장에서 영치우의 외국인 자원활동가가 칼에 맞는 사건도 있었다.

지난 2004년 12월 영치우의 사무국장이 지학순상을 수상하러 한국에 방문하고 있는 동안 사무실과 병원이 태국정부로부터 습격을 당하였다.
